Terms of Use

For the TV Remote mobile application (com.gamifyapps.tv.remote) on Android and iOS, and for this website.

The short version. TV Remote is licensed to you, not sold. It is free to use, and TV Remote Pro is a one-time purchase that never renews. Refunds go through your app store. We are not affiliated with Google, Apple, or any television manufacturer or streaming service. The app is provided as-is, and there are real limits to what a remote-control app can promise — sections 8 and 9 spell them out.

1. Acceptance of these terms

These Terms of Use ("Terms") are an agreement between you and GamifyApps ("we", "us", "our") governing your use of the TV Remote mobile application, its widgets and extensions, and the website at tvremote.gamifyapps.com (together, the "Service").

By downloading, installing or using TV Remote, you agree to these Terms. If you do not agree, do not install or use the app, and delete it if you already have.

Our Privacy Policy is incorporated into these Terms by reference and forms part of them.

2. Who may use TV Remote

You must be at least 13 years old to use TV Remote — or 16, if you are in a jurisdiction that sets that as the minimum age for consenting to data processing. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who accepts these Terms on your behalf.

You must also be legally permitted to use the Service under the laws that apply to you.

3. Your licence

TV Remote is licensed to you, not sold. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the app on devices you own or control, for your own non-commercial use.

All intellectual property in the Service — including its source code, design, artwork, icons, text and the TV Remote name — remains ours or our licensors'. Nothing in these Terms transfers ownership of anything to you.

Where the app includes open-source components, those components are licensed to you under their own licences, which prevail over this section to the extent they conflict. Attributions are available in the app.

4. What you may not do

You agree that you will not:

Copy, sell, rent, lease, sublicense, distribute or otherwise commercially exploit the Service, except as these Terms allow;
Reverse engineer, decompile or disassemble the app, or attempt to derive its source code, except to the extent that applicable law expressly permits this despite this restriction;
Remove, obscure or alter any copyright, trademark or other proprietary notice;
Use the Service to control a device you do not own or are not authorised to control;
Use the Service to access, cast or distribute content that you do not have the right to use, including content that infringes someone else's copyright;
Interfere with, disrupt, or attempt to gain unauthorised access to any network, device or system, including your own network's other users;
Circumvent, disable or interfere with the advertising in the free tier, or with the in-app purchase mechanism;
Use the Service in any way that breaks the law, or that breaches the rules of your app store, network operator or device manufacturer;
Use automated means to interact with the Service in a way that degrades it for others.

5. TV Remote Pro, payment and refunds

What Pro is

TV Remote Pro is a single, one-time, non-consumable in-app purchase. It is not a subscription. It does not renew, it does not expire, and no recurring charge is ever made. It unlocks the removal of advertising, unlimited video casting, Now Playing controls, the Android home-screen widget, unlimited saved televisions, automations, and Android screen mirroring.

Price and payment

The United States price is US $1.99. Your app store shows the equivalent in your local currency, including any local taxes.
Payment is processed entirely by Google Play or the Apple App Store. We never see or handle your payment details.
Prices may change for future purchasers. A price change never affects a purchase you have already made.

Restoring your purchase

Pro is tied to the store account you bought it with, not to a device. Use Settings › Restore purchases on a new device or after a reinstall, and your store will confirm the entitlement. If your store is unreachable, the app keeps your Pro features active rather than revoking them — we do not take away something you paid for because a network call failed.

Refunds

Refunds are handled by your app store under its own policy, not by us. Request one through Google Play or Apple's Report a Problem.
If you live somewhere with a statutory right of withdrawal or cancellation, that right applies in addition to your store's policy and nothing here limits it.
If a store refund is refused and you believe the app did not work as described, write to support@gamifyapps.com and we will try to help — although the store, not us, makes the final refund decision.

Before you buy video casting: the first video cast is free precisely so you can confirm it works on your television first. Cast support varies by television model, and we would rather you prove it than be refunded.

6. Advertising on the free tier

The free tier is funded by advertisements served by Google. By using the free tier you accept that advertisements will be shown, and that Google will process the data described in section 5 of our Privacy Policy.

We do not control which specific advertisements are served and we do not endorse the products in them. If you see an advertisement that is offensive, misleading or inappropriate, please report it to us at support@gamifyapps.com and we will pass it on.

Buying TV Remote Pro removes all advertising from the app.

7. Your network, your devices, your content

You are responsible for your own network. TV Remote operates over the Wi-Fi network you connect it to. Anyone else who can use that network can also, in principle, pair their own device with your television.
You are responsible for what you cast. You confirm that you have the right to display any photo, track or video you send to your television. We do not see, store, host or transmit your files — your own phone serves them directly to your own television.
You are responsible for the televisions you control. Only pair with devices you own or have permission to operate.

8. Compatibility and known limitations

We state these plainly rather than burying them, because they determine whether the app is useful to you at all:

Android TV and Google TV only. TV Remote does not work with Roku, Samsung Tizen, LG webOS, Amazon Fire TV or Apple TV, and we make no claim that it does.
Same network required. The app cannot reach your television over mobile data, and some routers and nearly all guest networks block device-to-device traffic entirely.
Screen mirroring is Android-only. iOS cannot mirror its screen to an Android TV, and we do not sell that ability on iOS.
The iOS widget opens the app rather than sending presses, for the platform reasons described on the iPhone page.
Wake TV cannot be guaranteed. Most televisions on Wi-Fi disable their network radio when powered off and cannot receive a wake packet at all; many streaming dongles never support it. A wake packet is sent without any acknowledgement, so no app can confirm it worked.
Casting depends on your television. Some paired televisions have no Cast receiver. Supported formats are MP4, M4V and WebM for video, MP3, M4A, AAC, FLAC and WAV for audio, and JPG, PNG, GIF and WebP for images. There is no transcoding, and MKV and AVI are refused before you pick them.
Televisions can forget a pairing. Some sets drop stored pairings on a firmware update, and some keep only a small number at once. Re-pairing takes seconds, but it is the television's behaviour and not something we can prevent.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, error-free, or compatible with any particular television, phone, router or network configuration; that defects will be corrected; or that any wake, cast or key-press command will reach or be acted on by your device.

Some jurisdictions do not allow the exclusion of implied warranties, so some or all of this section may not apply to you, and nothing here limits any non-excludable statutory consumer right you have.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of or inability to use the Service — even if we have been advised that such damages are possible.

Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you actually paid us for the Service in the twelve months before the claim arose, or (b) US $10.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, your statutory rights are unaffected.

11. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, your infringement of anyone's rights, or content you chose to cast.

12. Third parties and trademarks

TV Remote is an independent application. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to Google LLC, Apple Inc., or any television manufacturer or streaming service.

Android, Android TV, Google TV, Google Play, Chromecast and the Google Play logo are trademarks of Google LLC. Apple, iPhone, iPad, App Store and AirPlay are trademarks of Apple Inc. Netflix, Prime Video, YouTube, Disney+, NVIDIA SHIELD, Roku, Samsung, LG and Amazon Fire TV are trademarks of their respective owners.

All such names are used solely to describe compatibility and to help you identify which devices and applications the Service works with — nominative fair use. Their appearance implies no partnership, sponsorship or endorsement in either direction.

The Service links to and interoperates with third-party services (your app store, Google's advertising network, your television's own software). Those services have their own terms and privacy policies, and we are not responsible for them.

13. Apple App Store terms

This section applies only if you obtained TV Remote from the Apple App Store. You also agree to Apple's Licensed Application End User License Agreement, and where these Terms are less restrictive than Apple's minimum terms, Apple's minimum terms apply.

Apple is not a party to these Terms. These Terms are between you and GamifyApps only. Apple is not responsible for TV Remote or its content.
Scope of licence. Your licence is limited to a non-transferable licence to use TV Remote on Apple-branded products you own or control, as permitted by the App Store's Usage Rules, and it may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
Maintenance and support are our sole responsibility, not Apple's. Apple has no obligation to furnish any maintenance or support services for TV Remote.
Warranty. In the event of any failure of TV Remote to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to TV Remote, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.
Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to TV Remote or your use of it — including product liability claims, claims that TV Remote fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
Intellectual property claims. In the event of any third-party claim that TV Remote or your use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
Third-party beneficiary. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Google Play terms

This section applies only if you obtained TV Remote from Google Play. Your use is additionally subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for TV Remote. Purchases and refunds are handled by Google under Google Play's payment and refund policies.

15. Updates and availability

We may release updates that add, change or remove features. We may also discontinue the Service, or any part of it, at any time. Where we discontinue a feature that TV Remote Pro unlocked, we will say so clearly in the app and in the store listing before the change takes effect wherever it is practical to do so.

Your operating system may install updates automatically. Older versions of the app are not supported, and we cannot guarantee they will keep working as televisions and platforms change.

16. Termination

You may end this agreement at any time by deleting the app. We may suspend or terminate your licence if you materially breach these Terms — in practice, by no longer supporting a use that breaks them.

On termination, your licence ends and you must stop using the Service. Sections 4, 9, 10, 11, 12 and 18 survive termination. Terminating your licence does not entitle you to a refund except where the law or your store's policy requires one.

17. Changes to these terms

We may update these Terms. We will change the "last updated" date at the top and raise the version number, and material changes will be announced in the app before they take effect. Continuing to use the Service after a change takes effect means you accept the revised Terms; if you do not accept them, stop using the Service and delete the app.

18. General

Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service, and replace any earlier understanding about it.
Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest remains in force.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition or sale of assets, on notice to you.
Consumer rights. If you are a consumer, you keep the benefit of any mandatory rights and protections that the law of your country of residence gives you, and nothing in these Terms overrides them.
Language. These Terms are written in English. Any translation is provided for convenience, and the English version prevails in the event of a conflict.
Force majeure. We are not liable for failures caused by events outside our reasonable control.
